1. Agreement to Terms

By accessing or using Firecard's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Service Description

Firecard provides virtual Visa® card services that enable users to spend cryptocurrency online. Our services include:

  • Virtual card creation and management
  • Cryptocurrency deposit processing and conversion to USD
  • Transaction processing for online purchases
  • Balance management and transfers between users
  • Apple Pay and Google Pay integration (for eligible cards)

3. Eligibility

To use our services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Not be located in a restricted jurisdiction
  • Provide accurate and complete registration information
  • Not use our services for illegal activities

4. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your contact information is accurate and up-to-date

5. Virtual Card Usage

When using Firecard virtual cards:

  • Each card can be loaded up to $25,000 USD
  • Cards are for online transactions only
  • You may create unlimited virtual cards
  • Cards must not be used for illegal purchases or services
  • Certain merchant categories may be restricted
  • Apple/Google Pay is available for cards with $500+ balance

6. Cryptocurrency Deposits

When depositing cryptocurrency:

  • Cryptocurrency is automatically converted to USD at current market rates
  • Conversion rates are final once processed
  • Deposits require blockchain confirmation
  • Minimum deposit amounts may apply
  • You are responsible for sending to the correct wallet address
  • Incorrectly sent funds cannot be recovered

7. Fees and Charges

We charge fees for card creation, loading, and certain transactions. All fees are displayed transparently before you complete any transaction. Fees are subject to change with notice. We reserve the right to modify our fee structure at any time.

8. Prohibited Activities

You may not:

  • Use our services for money laundering or terrorist financing
  • Purchase illegal goods or services
  • Engage in fraudulent transactions
  • Violate any laws or regulations
  • Share or resell your account access
  • Circumvent our security measures
  • Use automated systems to access our services

9. Refunds and Disputes

Merchant refunds are processed back to your card balance. Cryptocurrency deposits are non-refundable once converted to USD. For transaction disputes, contact our support team within 30 days. We will investigate disputes in accordance with Visa® card network rules.

10. Service Availability

We strive to maintain service availability but do not guarantee uninterrupted access. We may suspend services for maintenance, updates, or security reasons. We are not liable for any losses resulting from service interruptions.

11. Account Termination

We reserve the right to suspend or terminate your account if:

  • You violate these Terms of Service
  • You engage in fraudulent or illegal activities
  • We are required to do so by law
  • Your account poses a security risk

You may close your account at any time. Upon termination, you must withdraw any remaining balance.

12. Limitation of Liability

Firecard and its affiliates are not liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability is limited to the amount of fees you paid in the 12 months preceding the claim.

13. Disclaimer

Our services are provided "as is" and "as available" without warranties of any kind. We do not guarantee that our services will be error-free, secure, or meet your requirements. Cryptocurrency values are volatile, and we are not responsible for market fluctuations.

14. Changes to Terms

We may modify these Terms of Service at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms. We will notify users of significant changes via email.

15. Governing Law

These Terms of Service are governed by and construed in accordance with applicable laws. Any disputes arising from these terms or our services shall be resolved through binding arbitration.
